Service Use and Service Data
Next Gen Math provides the Services solely to and through subscribing schools, school districts, and other educational institutions (“Schools”). Identity information for Students, Teachers, and Administrators for Service delivery is provided to Next Gen Math by Schools and is not separately solicited by Next Gen Math. The information provided to us by Schools may include certain individually identifiable information, including Students’ names, Teachers’ names, and Administrators’ names and titles. We collect and record data identifiable to Teachers and Administrators regarding their use or administration of, and interaction with, our Services. Collectively, the information we receive regarding Students, Teachers, and Administrators and that is generated through their interaction with our Services constitutes Service Data as defined above.
Next Gen Math uses Service Data solely to deliver the Next Gen Math Services to and through associated Schools, provide Students with individualized content within those Services, and provide Teachers and Administrators with reports on Students’ academic progress in using the Services. Next Gen Math does not collect any more individually identifiable information about Students, Teachers, and Administrators than is reasonably necessary to administer and provide our Services and individualized content to Students and their Schools, to enable participation in School-sanctioned Student contests, and to generate School-requested reports on individual Student academic progress. Next Gen Math may also perform internal research and analysis on aggregated and anonymous Service Data to assess Service effectiveness and improvements in Student performance.
Next Gen Math does not sell or rent Student, Teacher, or Administrator Service Data and does not share it with advertisers or data brokers. Except as described in this Privacy Policy—including LMS and Platform Integrations when a School or its authorized users (for example, a Teacher) enable an integration, disclosures required by law, disclosures to subprocessors operating under our direction to host or operate the Services, and the limited Website analytics practices described below—we do not disclose Service Data to unaffiliated third parties for their own purposes.
Students, Teachers, and Administrators are provided private user names and passwords to access applicable Services and associated Service Data by Next Gen Math. These identification credentials allow Students to gain access to the Services to which their Schools subscribe and allow Teachers and Administrators to track Student progress and assignment completion. Next Gen Math Services and associated Service Data are not made accessible to anyone other than our employees, contractors, and agents involved in Service development, delivery, and administration and those accessing the Services or associated Service Data using assigned user names and passwords. When a School or Teacher connects an optional integration with an external learning platform, designated Service Data (such as assignment scores, assignment or course identifiers, and information used when calling that platform’s APIs to align Students—for example email on file in Next Gen Math) may be transmitted to that platform as described under LMS and Platform Integrations; that transmission is separate from sharing account passwords with those platforms.
If the parent or legal guardian of a Student wants to review the information that Next Gen Math has collected about the Student or learn more about the Service(s) the Student is participating in, he or she should contact the Student’s School.
Next Gen Math makes reasonable efforts to secure Service Data against unauthorized access. These efforts include employment of physical, administrative, and technical safeguards based on currently available technology and practices to promote the integrity and security of the Services and Service Data. In certain of our Service materials we include links to other websites. This Privacy Policy does not apply to such external links, and we make no representations concerning the privacy policies followed by linked websites. In the event that Next Gen Math is acquired by or merged with a third-party entity, we may transfer or assign Service Data as part of such merger, acquisition, sale, or other change of control, unless otherwise prohibited by applicable law.
LMS and Platform Integrations
Next Gen Math supports optional connections to learning management systems and related platforms so Schools can align assignments and grades with tools they already use. Each integration is activated only when authorized by the School or an appropriate user (for example, a teacher connecting an account or enabling a link). A given connection is optional, is established for that individual user, and—once enabled—Next Gen Math may interact with that platform only as that user enables and the product supports.
When an authorized user connects an integration, they authorize Next Gen Math to do the following:
- Assignment linking and assignment push: Create or update assignments on the LMS and store identifiers that link Next Gen Math assignments to the corresponding course and assignment (or equivalent) on that platform, plus metadata the teacher selects.
- Grade synchronization: Send Students’ scores for linked work to the LMS gradebook (or equivalent) through the vendor’s API.
- Student matching: We align Students with each LMS using school-provided information—most often email addresses on file in Next Gen Math—and use each vendor’s APIs as needed (for example, Google Classroom submissions and related data) to locate the correct Student record when syncing grades.
Data sent to a platform is limited to what is needed to provide the connected features. Those platforms process the data under their own terms and privacy policies once received. For LMS integrations described in this section (including the subsections below), we do not sell or rent related personal information or share it with data brokers, and we do not use it for third-party advertising or for marketing on behalf of others. Next Gen Math may send first-party communications about the Services and features you use, including LMS integrations you have connected.
What we store. For each authorized connection we store OAuth access and refresh tokens (or equivalent API credentials), the teacher’s user identifier on that LMS, link records that tie Next Gen Math assignments to courses and assignments on that platform, and related metadata. This information is kept in our encrypted database. We do not store students’ LMS-issued or external user IDs from Google Classroom, Canvas, or Schoology—including for API calls used to match Students or sync grades.
Data retention. Tokens and the teacher’s LMS user identifier for a connection are retained until the teacher disconnects that integration in Next Gen Math or requests deletion. Teachers can disconnect LMS integrations from their Next Gen Math account settings. To request deletion of integration-related data, contact support@nextgenmath.com.
How we use LMS API data. We use information from these connections—including tokens, the teacher’s LMS user identifier, course and assignment metadata, roster-matching inputs such as email on file in Next Gen Math, responses returned from LMS APIs while performing a given operation (for example submission or enrollment data needed to post a grade), and scores—only to provide the assignment linking, grade synchronization, and roster alignment features described in this section. When we invoke an LMS API, the necessary assignment and score data are sent to that vendor’s systems and processed under that vendor’s terms and privacy policy (Google for Google Classroom, Instructure for Canvas, PowerSchool for Schoology).
These integrations are school-directed and support instructional and recordkeeping tasks Schools would otherwise perform with their own staff and tools. Our collection and use of personal information for them is in furtherance of those tasks, under the School’s direction, and is consistent with the Family Educational Rights and Privacy Act (FERPA) and applicable state student privacy requirements where they apply.
Google Classroom
Google Classroom uses Google’s APIs with teacher-authorized OAuth credentials; storage, retention, student matching, and permitted use are as described under LMS and Platform Integrations above. Google APIs supply teacher account details (including name, email address, and Google user ID), course and coursework information, and—when related features are used—data from student submissions and related endpoints needed to operate the integration (for example, to match a Next Gen Math Student to the correct submission using email and to post grades). We do not store students’ Google user IDs in Next Gen Math. Next Gen Math’s use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Canvas (Instructure)
Canvas uses the Canvas REST API with teacher-authorized OAuth credentials; storage, retention, student matching, and permitted use are as described under LMS and Platform Integrations above. Data processed on Canvas is subject to Instructure’s terms and privacy policy.
Schoology
Schoology uses Schoology’s APIs with teacher-authorized credentials; storage, retention, student matching, and permitted use are as described under LMS and Platform Integrations above. Data processed on Schoology is subject to PowerSchool’s terms and privacy policy for that platform.
LTI 1.3
Where a School uses LTI 1.3, a Student may access Next Gen Math by launching from the School’s learning management system. We receive and store the platform-supplied LTI user identifier for that Student so we can associate their activity with their Next Gen Math account. When grade return is configured for the integration, we send scores to the LMS gradebook using the identifiers and payloads the LTI specification requires. The LMS processes those results under its agreement with the School.
General Terms for Website User Data
Next Gen Math does not require Website visitors to register to access general information on our Website. The educational Services are not available to the general public through self-service registration; user accounts for Students, Teachers, and Administrators are established through subscribing Schools, as described under Service Use and Service Data above. For Students, Teachers, and Administrators who access our Services through the Website, specific terms applicable to collection and use of Service Data are described above, but the following terms also apply to your use of the Website, including access to Services through the Website.
1. Website Use Information Collected
We may collect information about your use of certain Website features to enable us to understand how visitors access and use the Website and to better tailor the content and content access options of the Website to you and other Website users. In connection with these efforts, we may use various technologies that automatically record certain technical information from your browser or device, including standard log files, web beacons, or pixel tags. The technical information we collect may include your Internet Protocol (IP) address, browser type, internet service provider (ISP), referring or exit pages, click stream data, device operating system, and the dates and times that you visit the Website.
Like most websites we may send one or more cookies – small text files containing a string of alphanumeric characters – to the device by which you access the Website. Cookies collect and retain information about user activities on a website. Their use enables us to provide a more personalized experience to visitors, including Students, Teachers, and Administrators who access Services through the Website. Next Gen Math may use both session cookies and persistent cookies. A session cookie disappears automatically after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Website. You can, however, remove a persistent cookie at any time. Please review your web browser’s “Help” file or menu to learn the proper way to modify your cookie settings. However, without cookies you may not have access to certain services and features of the Website. Next Gen Math may use third-party service providers, Google Analytics™ to understand our Website usage.
Lastly, We partner with Microsoft Clarity to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. 2. Correspondence and Information Requests
Users of the Website may submit comments, questions, and other correspondence and make requests for information about our Services via the Website. Personal information submitted in connection with such correspondence and requests is treated consistent with this Privacy Policy. For correspondence received from children we believe are under the age of 13, we will not identify them using provided personal information without their parent’s or guardian’s consent.
3. Access and Use of Collected Information
Next Gen Math permits access to information about Website visitors only to those of its employees who have a legitimate operational reason for such access. Next Gen Math does not rent or sell personal information that we collect to third parties. In certain instances, Next Gen Math may work with business partners to improve our services or offerings. We may disclose automatically collected and other aggregated anonymized data to authorized business partners to conduct research on online education or assist in understanding the usage, viewing, and demographic patterns for certain Services and/or functionality on the Website.
Next Gen Math may also disclose Website usage information if required to do so by law, or if we have a good-faith belief that such action is necessary to comply with local, state, federal, international, or other applicable laws (such as U.S. Copyright law) or respond to a court order, judicial or other government subpoena or warrant, or administrative request. In some cases, we may make such disclosures without first providing notice to applicable Website users.
Next Gen Math may disclose information as we believe in good faith is appropriate or necessary to take precautions against liability; to protect Next Gen Math from fraudulent, abusive, or unlawful use of Services or the Website; to investigate and defend ourselves against any third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Website and Service delivery; or to protect the rights, property, or personal safety of Next Gen Math, our users, or others.
4. Children Users
Except for Service Data received from Schools and generated by Student access to and use of Services, Next Gen Math does not solicit and does not knowingly acquire, store, or use personal information relating to children who are less than 13 years of age. If Next Gen Math learns that personal information of persons less than 13 years of age (other than Service Data) has been collected via the Website without the consent of a parent or educational institution, then Next Gen Math will take appropriate steps to delete this information from its systems.
5. Data Security
Next Gen Math makes reasonable efforts to secure our Website and the information users send to us against unauthorized access and corruption. These efforts include employment of physical, administrative, and technical safeguards based on currently available technology and practices to promote the integrity and security of Website user information we collect.
As an alternative to a user name and password login, a School may choose to use QR code badges to authenticate student users. The QR code provided by the School to the student (usually in the form of a laminated card or paper print-out) which recognizes a user’s Next Gen Math account when the QR code is read by the camera on a Chromebook, laptop or other device. Next Gen Math does not collect or store any image collected by the device camera. The camera content is processed on the users’ device and Next Gen Math only receives the tokens used for authentication. You can learn more about Next Gen Math QR code badges here.
6. User Data Retention and Anonymization
For user accounts that have been deleted or are inactive in our system, Next Gen Math anonymizes personally identifiable information (PII)—such as name, email, and username—after 90 days. This reduces retention of identifiable data while preserving non-identifying information that may be needed to restore an account if a user is re-enrolled by their school or district.
7. Website Links
The Website may be linked to websites operated by other entities or individuals. Some of these websites, such as our Facebook™ page, may be co-branded with our name or logo. This Privacy Policy does not apply to, and we cannot always control the activities of, such other third-party websites. You should consult the respective privacy policies of these third-party websites.
8. Changes and Updates to this Privacy Policy
Next Gen Math may modify or revise this Privacy Policy from time to time. Changes to our Privacy Policy will become effective when posted, with an updated date of revision, on our Website.
